LittleMore Terms and Conditions

1. Introduction

Welcome to LittleMore ("we", "us", "our"), an online marketplace platform designed for the South African market that enables users to list, browse, buy, and sell pre-owned baby and children's products. LittleMore operates as a facilitator only and is not a party to any transaction between buyers and sellers.

By accessing or using the LittleMore website, mobile site, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Platform.

These Terms should be read together with our Privacy Policy, which explains how we collect and process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

2. Definitions

"User" / "Visitor": Any person who accesses or browses the Platform.
"Member": A User who has created an account on the Platform.
"Seller": A Member who lists items for sale.
"Buyer": A User or Member who purchases or attempts to purchase items.
"Listing": An advertisement placed by a Seller for a product.

3. Eligibility and Accounts

3.1 You must be at least 18 years old to create an account on LittleMore.

3.2 Only registered Members may place Listings or sell items on the Platform.

3.3 You agree to provide accurate, current, and complete information when creating an account and to keep your account details up to date.

3.4 You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

3.5 LittleMore reserves the right to suspend or terminate accounts that breach these Terms or applicable laws.

4. Nature of the Platform (Marketplace Disclaimer)

4.1 LittleMore is a classified-style marketplace only. We do not:

Own, inspect, manufacture, store, or deliver any products;
Act as agent, broker, or representative of buyers or sellers;
Guarantee the quality, safety, legality, or suitability of any item listed.

4.2 All transactions are concluded directly between buyers and sellers, at their own risk.

5. Listings and Seller Obligations

5.1 Sellers warrant that:

They are the lawful owner of the item or authorised to sell it;
Items listed are pre-owned unless clearly stated otherwise;
All information, images, and descriptions are accurate and not misleading;
Items comply with South African laws and safety standards.

5.2 The sale of recalled, unsafe, illegal, counterfeit, or prohibited baby products (including expired car seats, unsafe sleep products, or recalled goods) is strictly prohibited.

5.3 Sellers are solely responsible for pricing, communication, delivery arrangements, and compliance with consumer protection laws where applicable.

6. Buyer Responsibilities

6.1 Buyers acknowledge that items are typically sold "as is", unless otherwise agreed between buyer and seller.

6.2 Buyers are responsible for:

Conducting their own due diligence;
Inspecting items where possible before finalising a transaction;
Agreeing payment and delivery terms directly with the seller.

6.3 LittleMore does not guarantee refunds, returns, or dispute outcomes.

7. Payments

7.1 Unless explicitly stated otherwise, LittleMore does not process payments on behalf of users.

7.2 Any payment arrangements are made directly between buyers and sellers.

7.3 LittleMore is not responsible for failed payments, chargebacks, fraud, or non-delivery.

8. Prohibited Conduct

Users may not:

Post false, misleading, or fraudulent Listings;
Use the Platform for unlawful purposes;
Harass, abuse, or harm other users;
Circumvent or attempt to bypass platform safeguards;
Copy, scrape, or misuse Platform content or data.

9. Content and Intellectual Property

9.1 Users grant LittleMore a non-exclusive, royalty-free licence to use, display, and promote Listings and related content for platform operation and marketing.

9.2 All Platform branding, software, and content (excluding user-generated content) remain the intellectual property of LittleMore.

10. Limitation of Liability

10.1 To the maximum extent permitted by South African law, LittleMore shall not be liable for:

Any loss, injury, damage, or death arising from the use of products purchased via the Platform;
Financial loss, fraud, misrepresentation, or disputes between users;
Website downtime, errors, or data loss.

10.2 Use of the Platform is entirely at your own risk.

11. Indemnity

You agree to indemnify and hold harmless LittleMore, its directors, employees, and partners from any claims, losses, or damages arising from:

Your use of the Platform;
Your Listings or transactions;
Breach of these Terms or applicable law.

12. Privacy and POPIA Compliance

Personal information is processed in accordance with POPIA and our Privacy Policy. By using the Platform, you consent to such processing.

13. Suspension and Termination

LittleMore may suspend or terminate access to the Platform at its discretion, with or without notice, if these Terms are breached or where required by law.

14. Amendments

LittleMore may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. South African courts shall have exclusive jurisdiction.
